ORDER

This petition has been filed seeking for the transfer of the proceedings pending in C.C.No.100 of 2019, on the file of the Fast Track Judicial Magistrate No.I, Coimbatore.

2. The only ground that has been raised for transfer is that the petitioner is aged about 70 years and due to age related ailments, he is not in a position to attend on every hearing before the Court below.

3. Heard, the learned counsel appearing for the petitioner.

4. The ground raised by the petitioner is not enough to transfer the proceedings. This Court is therefore, not inclined to transfer the pending proceedings. https://hcservices.ecourts.gov.in/hcservices/

5. Taking into consideration, the facts and circumstances of the case, the petitioner shall be represented by a counsel before the Court below and the petitioner shall be present before the Court below as and when required by the Court. The learned counsel representing the petitioner shall cross examine the witnesses on the same day they are examined in chief.

6. This Criminal Original Petition is disposed of with a direction to the Fast Track Judicial Magistrate No.I, Coimbatore,to dispose of C.C.No.100 of 2019, within a period of four months from the date of receipt of copy of this order.
