Respondent Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the learned Principal Sessions and District Judge, (Special Judge), SC/ST Act cases, Tiruppur District to consider the bail application filed by the petitioners on their surrender in connection with Crime No.2177 of 2020 on the file of the respondent police on the same day.

ORDER

This Criminal Original Petition has been laid by the petitioners seeking direction to the learned Principal Sessions and District Judge, (Special Judge), SC/ST Act cases, Tiruppur District to consider the surrender of the petitioners herein in Crime No.2177 of 2020 on the file of the respondent police and consider the bail petition on the same day itself.

2. According to the petitioners, they stand arrayed as accused in crime No.2177 of 2020, for the alleged offences under Sections 294(b), 323, 506(ii) of IPC and 3(1) (r), 3(1) (s), SC/ST (POA) Amendment Act 2015. According to the petitioners, they have not committed the offences put forth against them and https://hcservices.ecourts.gov.in/hcservices/

on account of the false case alleged against them, the petitioners are necessitated to seek for necessary directions.

3. Considering the facts and circumstances of the case and in the interest of justice, I deem it fit to issue the following directions.

(i) The petitioners shall surrender before the Principal Sessions and District Judge, (Special Judge), SC/ST Act cases, Tiruppur District, within 10 days from the date of receipt of copy of this order.

(ii) On the petitioners surrendering before the Principal Sessions and District Judge, (Special Judge), SC/ST Act cases, Tiruppur District and filing the bail application, Principal Sessions and District Judge, (Special Judge), SC/ST Act cases, Tiruppur District is directed to consider and dispose of the bail application as expeditiously as possible, preferably on the date of surrender in accordance with law.

4. Accordingly, the Criminal Original Petition is disposed of.
