Accepting the averments made in the affidavits filed in support of the applications, these applications are allowed, the abatement caused due to the death of the 3rd defendant is set aside and the proposed parties viz., respondents 5, 6 and 7 are brought on records as the defendants 5, 6 and 7 in the testamentary original suit.

3. The learned counsel for the plaintiffs to carryout amendment and file amended copy of the testamentary original suit by 12.11.2021.
