Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition as the petitioners are ordered to be released on Bail on their executing an individual bond a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Senthamangalam instead of the petitioners are ordered to be released on Bail on their executing an individual bond a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, of whom, one should be a blood related surety, each for a like sum to the satisfaction of the Learned Judicial Magistrate, Senthamangalam order passed in Crl.O.P.No.14596/2021 dated 17.08.2021. Order: This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. M.
SUBASH, Advocate for the Petitioner and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed seeking to modify the condition imposed by this Court in Crl.O.P.No.14596 of 2021 dated 17.08.2021.
2.The learned counsel for the petitioners would submit that the petitioners were granted bail by this Court, imposed a condition that the petitioners were ordered to be released on bail on their executing an individual bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, of whom, one should be a blood related surety, each for a like sum to the satisfaction of the learned Judicial Magistrate, Senthamangalam He further submit that the petitioners not in position to execute a blood related surety bond as the village administrative Officer refused to issue solvency certificate to the petitioner's blood relatives on account of they are residing at refugee's camp. Hence, he have filed a present petition before this Court.
3.Heard both sides.
4.Considering the submission made by the learned counsel for the petitioners, the condition imposed on the petitioners by this Court in Crl.O.P.No.14596 of 2021 dated 17.08.2021, is modified to the effect that the petitioners are ordered to be released on bail on their executing an individual bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, of whom, one should be a blood related surety without obtaining a solvency certificate from the concerned authority, each for a like sum to the satisfaction of the learned Judicial Magistrate, Senthamangalam. The other conditions imposed by this Court shall remain unaltered. 5.Accordingly, this Criminal Original Petition is modified. -sd/- 03/09/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
