A.No.3750 of 2014 is filed seeking to permit the petitioner to amend the Original Petition.

A.No.3751 of 2014 is filed seeking to implead Mrs.Ellammal, D/o. Annamalai residing at No.16/19, Pallavan Salai, Nesapakkam, Chennai - 78 as 15th respondent.

2. On perusal of the affidavit filed in perusal of the application, it is mentioned that the one of the daughter of the testatrix namely Ellammal died as spinster, however, it came to light to the petitioner that Ellammal is still alive. Therefore, amendment has to be made in the petition indicating her existence. Hence, these applications.

3. Considering the nature of amendment, wherein, the proposed party is also to be brought on record, this Court is of the view that the amendment sought will not change the nature and character of the petition. 4. Consequently, the application in Application No. 3751 of 2014 seeking to implead the said Ellammal, is also ordered, accordingly.

5. The Registry is directed to carry out the necessary amendments and the petitioner shall also file amended copy. Thereafter, fresh notice shall be served to the 15th respondent returnable by 22.12.2023. Private notice is also permitted.

6. List the Original Petition on 22.12.2023.
