2. When the Writ Petition was listed on 05.08.2014, at the request of the learned counsel for the petitioner, the matter was adjourned to 12.08.2014. On that day also, the learned https://hcservices.ecourts.gov.in/hcservices/
counsel for the petitioner did not argue the matter and sought adjournment. Thereafter, the matter was listed again, but it is still pending without even ordering notice and admission. Today, when the matter is listed, there is no representation for the petitioner, which shows that the petitioner is not interested to proceed with the Writ Petition any further.
3. That apart, in the Writ Petition the petitioner sought for a direction to the respondents to enquire and recognise the petitioner's name in the subject land. It is nothing but a declaration and it cannot be considered in a Writ Petition filed under Article 226 of the Constitution of India. Therefore, the Writ Petition is devoid of merits. Hence, the Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
