The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 5 and 7(3) of Lotteries Regulation Act, 1998, in Crime No.557 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with A1 were found selling of lottery tickets. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is arrayed as A2. He would further submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner along with A1 were found selling of banned lottery tickets. He would also submit that the petitioner has 4 previous cases similar in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

5. Taking into consideration the facts and circumstances of the case, the custodial interrogation of the petitioner is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
