CMP.No.13081 of 2019 in S.A.No.804 of 2005 N.SESHASAYEE.J., This Civil Miscellaneous Petition is filed to condone the delay of 1364 days in filing the petition to set aside the abatement caused due to the death of the second respondent namely Kuppusamy Moopar in the above second appeal in S.A.No.804 of 2005.

2. Ms.R.Meenal, learned counsel enters appearance for the proposed respondents.

3. Heard Ms.Gayathri, learned counsel appearing for M/s.Sarvabhauman Associates for the petitioners and Ms.Meenal, learned counsel for the proposed respondents.

4. Having regard to the submissions made by the learned counsels and also having satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered and delay is condoned.
