This petition has been filed seeking for transfer of M.C.No.1 of 2014, pending on the file of the learned Judicial Magistrate, Sankarapuram.

The respondent has initiated proceedings under Section 125 of Cr.P.C. seeking for maintenance.

This petition has been filed seeking for transfer only on the ground that there is a threat to the petitioner, when he attends for enquiry before the Judicial Magistrate Court, Sankarapuram. The M.C. is of the year of 2014 and the case has come up for hearing this Court in the year 2018. This Court is not inclined to transfer the proceedings at this stage. The petitioner shall be represented by a counsel before the Court below and the petitioner shall be present before the Court below as and when directed by the Court below and all the other occasions the counsel can represent the petitioner. This Criminal Original Petition is disposed of with a direction to complete the proceedings within a period of three months from the date of receipt of a copy of this order.
