Prayer in CRP (NPD) No.612 of 2016 : Revision Petition is filed under Article 227 of the Constitution of India, seeking for a direction to the learned Subordinate Court, Poonamallee to expeditiously dispose off R.C.A.No.30 of 2011 pending on the file of Sub-Court, Poonamallee within a time frame fixed by this Court.
For Petitioner : Mr.P.J.Sri Ganesh (in both CRP's) C O M M O N O R D E R These Civil Revision Petitions have been filed seeking direction to the learned Subordinate Court, Poonamallee to dispose of R.C.A.Nos.29
of 2011 and 30 of 2011,(arising out of R.C.O.P.,Nos.64 and 65 of 2009 respectively) pending on the file of Sub-Court, Poonamallee within a limited time frame to be fixed by this Court.
2. The learned counsel for the revision petitioner has submitted that the even though R.C.O.Ps filed in the year 2009, had been disposed in the year 2011, the R.C.A. filed in the year 2011 has not been disposed of yet.
3. A perusal of the notes paper reveals that the Court had been waiting for the records from the Rent Controller from 03.02.2012 to 04.07.2015. For nearly 3 years, the Court has been waiting only for the records. Now on verification it is found that the records have been received by the Rent Control Appellate Authority. 3.1. Under such circumstances, an direction for speedy disposal by this Court cannot cause prejudice to the other side.
4. In view of the same, the Rent Control Appellate Authority is directed to dispose of R.C.A.Nos. 29 and 30 of 2011, within a period of three months from the date of receipt of a copy of this order.
These Civil Revision Petitions are disposed of with the above directions. No costs.
