Common Prayer: These Criminal Original Petitions are filed under Section 482 of Cr.P.C. to call for the records relating to the summons dated 10.06.2024 pending on the file of the M1 Madhavaram Police Station, Chennai - 600 110 and quash the same.

For Petitioner : M/s.Dr.D.Simon For Respondent : Mr.S.Udaya Kumar Government Advocate (Crl.Side) - - - - - COMMON ORDER The petitioners are brothers. They both been summoned by the respondent police to participate in the enquiry pursuant to the complaint of one Jagadesh registered in C.S.R.No.686 of 2024. The learned counsel appearing for the petitioners stated that without registering F.I.R., the police cannot summon the petitioners to participate in the enquiry.

2. The learned counsel appearing for the petitioners submitted that he has filed a petition for direction and protection from the police since under the guise of investigating the complaint and the police continue to harass the petitioners.

This Court, on perusing the affidavit and the impugned summons, finds that it is money dispute between the petitioners and the complainant, which has led to registration of C.S.R.No.686 of 2024 by the respondent Police on 05.06.2024. The dispute is primarily in connection with money transaction between the parties. No criminality apparently made out on the complaint. Therefore, this Court finds no error in not registering F.I.R against the petitioner. At the same time, there is no error in summoning the petitioners to participate in the preliminary enquiry before registration of F.I.R. The petitioners, instead of participating in the enquiry and producing documents before the police, have filed these petitions.

4. This Court finds no reason to suspect the intention of the police calling upon the petitioners to participate in the enquiry. Hence, these Criminal Original Petitions are dismissed.
