PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondent Nos. 1 and 2 to transfer patta and effect necessary changes in the revenue records for the property ad-measuring 2 grounds and 913 square feet comprised in T.S.No. 5/25 Block No. 14, and situated at Door No. A114/82, 3rd Avenue, Anna Nagar, Chennai 600 102 from the name of Sathiyavanimuthu to the name of petitioner by virtue of the probate granted on 04.01.2002 in OP No. 68 of 2001 on the file of this Hon'ble Court and by considering the representation dated 26.10.2015. ORDER

The petitioner made a representation on 26.10.2015, to the respondent seeking transfer of Patta in his name with respect to the property situated in T.S.No. 5/25, Block No. 14, Door No. A114/82, 3rd Avenue, Anna Nagar, Chennai 600 102, which stood originally in the name of his deceased mother. The said request has been made on the ground that there is a Will executed by the deceased mother of the petitioner and all other legal heirs do not have any objection.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3. Considering the above facts and without going into the merits of the case, the respondent No. 2 is directed to pass appropriate orders on the pending representation of the petitioner dated 26.10.2015 within a period of eight weeks from the date of receipt of copy of this order, after affording an opportunity of hearing to the petitioner as well as other legal heirs of the deceased mother.

4. With the above direction, the writ petition is disposed of. No costs.
