ORDER

The present writ petition has been filed praying for a writ of Mandamus, directing the 2nd respondent to release all the retirement benefits payable to the petitioner including pension in pursuance of the petitioner retirement from service with effect from 30.04.2003.

2. At the outset, learned Special Government Pleader for respondents would submit that they would consider the petitioner's request and would further submit that petitioner may submit a fresh representation and the same would be considered by the third respondent in accordance with law, within a period to be stipulated by this Court. Agreed to by the learned counsel for petitioner.

3. In view thereof, the writ petition stands disposed of with liberty to the petitioner to submit a fresh representation before the third respondent. It is open to the petitioner to rely upon any decision, rules in support thereof. If any such fresh representation is made by petitioner, the same shall be considered by third respondent and appropriate orders shall be passed in accordance with law after affording a reasonable opportunity of hearing to petitioner and other interested parties within a period of eight (8) weeks thereafter. It is made clear that this Court has not expressed any views with regard to the merits of the petitioner's fresh representation and it is open to the concerned respondent to consider the petitioner's fresh representation on its own merits and in accordance with law. There shall be no order as to costs.
