Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1 to 6 respondents to implement the Ordinary Grade and Selection Grade Scales of Pay as indicated in Schedule - II of the Tamil Nadu Revised Scales of Pay Rules, 1998 at Rs.4000-6000 and Rs.50008000 respectively to the Petitioners Drivers from the respective dates of completion of 10 years of service in the ordinary Grade, with all consequential monetary benefits and pay all arrears within a stipulated time period.

O R D E R

The petitioners have filed this writ petition seeking direction to the respondents 1 to 6 to implement the Ordinary Grade and Selection Grade Scales of Pay as indicated in Schedule - II of the Tamil Nadu Revised Scales of Pay Rules, 1998 and for consequential benefits.

2.The case of the petitioners is that they are serving as Drivers in the Panchayat Development Wing in Villupuram District and have no promotional avenues. As per G.O.Ms.No.162, Finance (Pay Cell) Department dated 13.04.1998, the appropriate revised scales of pay for selection grade / special grade are indicated in Schedule - II to the Tamil Nadu Revised Scales of Pay Rules, 1998 and for posts having no promotional avenue, the selection grade and special grade shall be allowed as indicated in Schedule - II. According to the petitioners, they are entitled to get the benefits of G.O.Ms.No.162, Finance (Pay Cell) Department dated 13.04.1998. Hence, they made representation to the respondents and since there was no response, have filed this writ petition.

3.The learned counsel appearing for the petitioners submitted that subsequent to the filing of this writ petition, the Government issued G.O.Ms.No.114, Finance (Pay Cell) Department, dated 06.05.2014 and hence, nothing survives for adjudication.

4.Recording the above, this writ petition stands disposed

of, granting liberty to the petitioners to approach the respondents for any other relief. No costs.
