The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 and 430 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No. 277 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was in illegal possession of sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) would submit that the petitioner was in illegall possession of sand and he is having three previous cases similar in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner and taking note of the fact that the petitioner is having three previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
