JUDGMENT

(Judgment of the Court was delivered by R. SUBRAMANIAN J.) The petitioner has filed the present writ petition seeking to issue a Writ of Mandamus directing the Respondents to consider and pass orders on the petitioner's representation dated 18.07.2018 as per the provisions of the Street Vendors (Protection of Livelihood Regulation) Act, 2014 made for granting permission/Certificate of Vending and till such time not to disturb with the running of the petitioner's bunk shop near Railway Reservation, 3rd Avenue, opposite to Royal Enclave Apartments, Anna Nagar, Chennai  600 040.

2. Upon notice, Mr.A.Nagaraj, learned counsel appearing for the Chennai Corporation would submit that the representation of the petitioner was rejected by the Executive Engineer, Zone-VIII, Greater Chennai Corporation, No.36B, Pulla Avenue, Shenoy Nagar, Chennai  600 030 on the ground that

there was no Bunk shop in the location, as claimed by the petitioner.

3. Mr.L. Chandrakumar, learned counsel appearing for the petitioner would seek permission of this Court to withdraw the Writ Petition with liberty to challenge the said communication dated 20.09.2018. He has also made an endorsement to that effect.

4. In view of the endorsement made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn with liberty to challenge the communication dated 20.09.2018. No costs.
