The petitioner, who was arrested and remanded to judicial custody on 09.08.2023 in Crime No.532 of 2023 registered for the alleged offences punishable under Sections 174 Cr.P.C @ 302 IPC seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, as if he slapped the deceased and committed murder. Petitioner is a native of Bihar. He further submitted that he is no way connected with the alleged offence. He is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that due to a wordy quarrel between the petitioner and the deceased, the petitioner assaulted him and committed murder. He is the sole accused and the complainant is the wife of the deceased. Petitioner is from Bihar. If he is released on bail, there is a possibility of tampering the evidence. He further submitted that the investigation is not yet completed, therefore, he vehemently opposed to grant bail to the petitioner.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

5. Taking into consideration the facts and circumstances of the case and the submissions made by the learned Government Advocate (Crl.Side) and the fact that considering the gravity of offence, this case needs a detailed investigation, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed, with a direction to the trial Court to complete the trial within a period of three months from the date of receipt of a copy of this order, since he is in custody for more than 300 days.
