ORDER

This Transfer Miscellaneous Petition has been filed seeking to withdraw HMOP.No.92 of 2026 pending on the file of the Family Court at Puducherry, and transfer the same to Family Court, Madurai.

2. The learned counsel for the petitioner submits that the petitioner is living with 12 years old male child and now she shifted to his parental home at Cumbum, where the child continued his education through online classes. Therefore it difficult for her to travel to Ponchicherry to attend the Court hearings.

3. The learned counsel for the respondent raised objection submits that the respondent has filed HMOP.No.92 of 2026 on the file of the Family Court at Puducherry seeking for restitution of conjugal rights, the respondent always ready for reunion but the revision petitioner is not cooperating for that. Hence, the respondent filed the said petition. The respondent is doing business in Pondicherry and it is difficult for him to travel to Madurai to attend Court hearings.

4. Considering the facts and circumstances of the case, this Court is inclined to transfer HMOP.No.92 of 2026 pending on the file of the Family Court at Puducherry to Family Court, Madurai. However, the appearance of the

respondent is ordered to be dispensed with and instructed to appear before the Court as and when requires. The Family Court at Puducherry is directed to transfer case bundles within a period of 4 weeks from the date of receipt of a copy of this order. Thereafter both parties are directed to go before Mediation Centre attached to Family Court, Madurai for Mediation.
