Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 16.03.2020 and pass orders and thereby remove the encroachment made on the water body area within a time frame fixed by this court.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner complains of the complete inaction on the part of the respondent authorities in taking action against the encroachment complained of in a waterbody Amanjur Kuttai also known as Kasam Kolam at S.No.15 of Amandhur village.

2. Mr.P.Muthukumar, learned State Government Pleader, appears on behalf of the respondents.

Mr.Muthukumar, the Tahsildar of Thiruvallur Taluk in Thiruvallur District will be the appropriate person to deal with the matter.

3. Accordingly, the writ petitioner is permitted to carry a detailed representation to the said Tahsildar within a fortnight from date, whereupon the Tahsildar will conduct an inquiry upon notice to the petitioner and all others likely to be affected by the Tahsildar's action. In the event the Tahsildar finds any encroachment in any Government land or any waterbody, the Tahsildar will take immediate appropriate action in accordance with law upon due notice to the encroachers. It is hoped that if there is any encroachment as complained of, the same is removed upon following the procedure established by law, within a period of ten weeks of the receipt of the petitioner's representation by the Tahsildar.

W.P.No.18114 of 2021 is disposed of without any order as to costs.
