The petitioner, Doctor by profession is facing criminal case on the complaint given by erstwhile staff working as Pharmacist for offence under Section 420 and 506(i) of IPC been made in the complaint against the petitioner.
2.The learned counsel appearing for the petitioner seeks quash of the complaint on the ground that it was the defacto complainant who has defrauded petitioner while he was serving as Pharmacist. When that was questioned and criminal complaint lodged against the defacto complainant, to counter blast, the present complaint has been filed. From the submission made by the counsel, it appears it is case and counter. 3.The learned Additional Public Prosecutor is directed to instruct the Investigation Officer to investigate both the cases and proceed in accordance with the procedure established under law and file final report as per the material collected in the course of the investigation. The said exercise shall be 2 / 4
