Criminal Original Petition filed under Section 438 of Cr.P.C., to enlarge the petitioners on bail in the event of their arrest in Connection with the Crime No.2168 of 2020 pending on the file of the respondent police. ORDER

(This case has been heard through video conference) The petitioners who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 452, 294 (b), 324, 506 (ii) and 307 of IPC, in Crime No.2168 of 2020, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution as per the defacto complainant is that due to previous enmity, the petitioners have assaulted the defacto complainant with Aruval on his head, as a result of which, he sustained injuries. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He would further submit that they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that the injured has been discharged from the hospital. He would further submit that there are five previous cases as against the petitioners, out of which one is under section 302 IPC and another two cases are under Section 307 IPC and the second petitioner is concerned, yet another case is under Section 399 IPC. He would further submit that the petitioners are notorious elements. Hence, he vehemently opposed the grant of anticipatory bail to the petitioners.

5. Taking into consideration the facts and submissions of the learned Counsel and also the fact that the petitioners are notorious elements, this Court is not inclined to grant anticipatory bail to the petitioners.

With the above directions, this Criminal Original Petition is dismissed.
