PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to transfer the case in Crime No.129 of 2016 pending on the file of the respondent to any other investigating agency.

O R D E R

The Criminal Original Petition has been filed seeking a relief to transfer the investigation in Crime No.129 of 2016 pending on the file of the respondent herein to any other agency.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor, on instruction, would submit that in respect of the petition mentioned F.I.R., the respondent police had conducted an investigation only by placing reliance on the CCTV footage. Further, as of now, the process of investigation has been completed and thereafter, CD files have been submitted to the Additional Public Prosecutor for getting approval.

4. In this regard, the learned counsel for the petitioner prayed to direct any superior officer of the respondent police to monitor the investigation. https://hcservices.ecourts.gov.in/hcservices/

5. Now on considering the rival submissions made by the counsel appearing on either side, since the case has been registered for the offences punishable under Sections 452 and 307 of I.P.C. and 3(1) of TNPPPDL Act, 1992, and also for the reasons that the accused are identified by placing reliance on CCTV footage, it would be appropriate to direct the Assistant Commissioner, Valasaravakkam, to verify the final report, which has been prepared by the respondent police before submitting the same before the Court.

With the above observation, this Criminal Original Petition is disposed of.
