O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing respondent to consider the representation dated 23.12.2024 which was filed before respondent for fixation of Guideline Rate (GLR) value in respect of subject property.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The case of the petitioner is that she is the lawful owner of the property comprised in Ward 'O', Block No.4, T.S.No.14/31, R.S.No.224/29, Cadastre No.1089/2 measuring an extent of 2112 sq.ft situated at Murungapakkam Revenue Village vide Document No.17764 of 2017 registered on the file of Sub Registrar, office of the District Registrar, Puducherry. When the same was presented for registration, the Sub Registrar has informed that no GLR value has been assigned to the said

property. Petitioner thus submitted a detailed representation dated 23.12.2024 before respondent with regard to fixation of GLR value for the above said property. Since the same was not considered, the present writ petition has been filed before this Court.

4. At the outset, learned Additional Government Pleader (Puducherry) appearing for respondent, on instructions, would submit that GLR value for the aforesaid property has been fixed as '0' and in case, petitioner intends to assign GLR value, she may obtain NOC from the Temple authorities.

5. The relevant portion of the proceedings vide proceedings No.7279/SC(R)N/REV/C2/GLR/2025 dated 01.2.2025 is extracted hereunder:

"With reference to the subject mentioned above, I am to inform that you have requested for fixation of GLR value for the property located in Ward-O, Block-4, T.S.No.14/31 of 44-Murungapakkam Revenue Village.

Whereas, up on verification of the GLR record, it has been mentioned as "Temple Land" and the rate has been freezed to "Zero". Further, I am to state that as per the Gazette notification in G.O.Ms.No.66/1987 dt.18/05/1987, vide No.689/HRI/F.1/83 of Dept. of HRI, Puducherry, the land in Ward-O, Block-4, T.S.No.14/31 of 44-Murungapakkam Revenue Village belongs to Present Trustee, C/o.Varatharaja Perumal Kovil Devasthanam.

2. Hence, you are hereby requested to produce necessary NOC/Clearance from Temple Authorities / HRI in order to assign GLR value in respect of the property at Ward-O, Block-4, T.S.No.14/31 of 44-Murungapakkam Revenue Village."

6. Learned counsel for petitioner would submit that she may be granted liberty to file a fresh representation, which was agreed to by learned Additional Government Pleader for respondent.

7. Taking into consideration the facts and circumstances of the case and the grievance expressed by petitioner, there shall be a direction to petitioner to submit a fresh representation to respondent along with

necessary documents and also a copy of this order within a period of four weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. On such receipt, respondent shall pass appropriate orders within a period of four weeks thereon, after putting petitioner and any other interested parties, if any, on notice. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the respondent to consider the case on its own merits and in accordance with law.
