O R D E R
The writ petition has been filed seeking a direction to the respondents 1 and 2 to take appropriate action against the respondents 5 to 9, on the representation of the petitioner dated 24.08.2020.
2. The petitioner had constructed a house in a Government Poramboke land and maintaining the same till date. While so, the respondents 5 to 9 (Village Panchayatars) tried to encroach the above said land. Hence, the petitioner preferred a complaint before the first respondent in person on 10.02.2020. After coming to know about the petitioner's complaint, the respondents 5 to 9 and other persons were conducted Kangaroo Court and banished the petitioner's family from participating in a function, refused to provide water from common pipe and disallowed to enter into the village temple. Therefore, the petitioner has made a representation dated 24.08.2020 to the second and third respondents to take action against the persons involved in Kangaroo Court. However, no action has been taken till date.
3. Heard the learned counsel appearing on both sides and perused the materials available on record.
4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the case, directs the second and third respondents to consider the representation of the petitioner dated 24.08.2020, enquire into the same and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner as well as the respondents 5 to 9 and also the persons interested in this regard and by affording them an opportunity of personal hearing or virtual hearing or otherwise, considering their written objections and after verifying the relevant documents, within a period of six weeks from the date of receipt of a copy of this order.
5. With the above directions, the writ petition is disposed of. No costs.
