PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the 2nd respondent to issue patta in the name of petitioners in respect of the land in old S.No.236/2, New S.No.236/14 of Molassur Village as directed by the 1st respondent in his proceeding Na.Ka.426/2013/A2 dated 21.11.2013 pursuant to the decree of civil Court and order dated 25.09.2012 passed in W.P.No.27944/2011 on the file of this Court.

O R D E R

This petition has been filed seeking to direct the second respondent to issue patta in the name of petitioners in respect of the land in old S.No.236/2, New S.No.236/14 of Molassur Village as directed by the first respondent in his proceeding Na.Ka.426/2013/A2 dated 21.11.2013 pursuant to the decree of civil Court and order dated 25.09.2012 passed in W.P.No.27944/2011 on the file of this Court.

2. While pending this Writ Petition, the first respondent passed an order dated 25.06.2021. The learned counsel for the petitioners submitted that both the petitioners died and https://hcservices.ecourts.gov.in/hcservices/

therefore, the legal heirs of the petitioners may be given liberty to challenge the order passed by the first respondent in the manner known to law.

3. Recording the said submission, this Writ Petition is disposed of. The legal heirs of the petitioners are at liberty to challenge the order of rejection passed by the respondents before the appropriate forum. In such event, the period during which the Writ Petition was pending before this Court can be excluded for the period of limitation in filing the appeal or revision as the case may be. No costs.
