The petitioner National Insurance Company has filed these ten Transfer Civil Miscellaneous Petitions seeking to withdraw and transfer the MCOP.Nos.4356/2011, 640/2012, 5665/2012, 1133/2015, 1250/2015, pending on the file of the I Motor Accidents Claims Tribunal, Chennai and MCOP.Nos.1568/2012, 105/2013, 484/2015 pending on the file of the II Motor Accidents Claims Tribunal, Chennai respectively, to the file of the learned III Additional District Judge, Coimbatore to be tried along with the cases arising out of the same accident.

3.When these matters were called, the learned Counsel for the petitioner Insurance Company and the learned Counsel for the claimant in Tr.CMP.Nos.117 and 118/2018 fairly submitted that in Tr.CMP.Nos.117 and 118/2018 seeking transfer of MCOP.Nos.105/2013 and 484/2015 from the file of the II Motor Accidents Claims Tribunal to the III Additional District Judge, Coimbatore, the trial was already over. 4.Recording the said submission made by both sides that trial was already over in MCOP.Nos.105/2013 and 484/2015 pending before the II Motor Accidents Claims Tribunal, Chennai, this Court is of the view that the prayers for transfer cannot be entertained in Tr.CMP.Nos.117 and 118/2018 since the same have become infructuous.

5.Insofar as the remaining Transfer CMPs. are concerned,

it appears that in most of the cases, due to the passage of time, trial have already been commenced. Therefore, this Court is of the view that the prayers in the said Transfer CMPs. have also become infructuous.

6.In the result, all the Transfer CMP Nos.113 to 120/2018 are dismissed. Consequently, connected Miscellaneous Petitions are closed.
