ORDER

This Criminal Original Petition has been filed calling for the records in FIR Crime No.18 of 2021 now pending investigation on the file of the first respondent and to quash the same.

2. The learned counsel for the petitioner submitted that the petitioner came into contact with the defacto complainant through Christian Matrimony. In fact, the defacto complainant had booked a room in Kuber Inn Metro, T.Nagar, Chennai, on 22.10.2020. Thereafter, she threatened the petitioner claiming ransom. The defacto complainant is aged one year more than the petitioner. The complaint allegations are totally false and there is a delay of one year in giving the complaint. Therefore, this petition.

3. In response, the learned Government Advocate (Crl.Side) appearing for the first respondent submitted that the investigation in this case is almost completed and final report has to be filed in due course.

4. Considered the rival submissions and perused the records.

5. The FIR allegations show that the defacto complainant and the petitioner came into contact through Christian Matrimony in January, 2019. They exchanged their bio-data and started moving closely. They visited to restaurant, beach and cinema. The petitioner got money from the second respondent little by little. On 21.10.2020, the petitioner came in a two wheeler claiming that he bought a new bike and took her for ride. On that day the petitioner had sexual relationship with her, on the promise of marrying her, at the residence of the second respondent. He also received a sum of Rs.50,000/- from her for the purpose of two wheeler. Thereafter, when the second respondent contacted the petitioner over phone, he avoided her and stated that he cannot marry her and said that they will be friends. Then, he also blocked the contact of the second respondent. When the second respondent contacted his father, his father also said that his son had not committed any offence. In the said circumstances, the complaint has been filed.

6. The FIR allegations clearly make out a commission of cognizable

offences by the petitioner. The learned counsel for the petitioner submitted that the second respondent only booked a room and invited the petitioner. This claim is a matter for investigation by the respondent Police. The petitioner may produce the documents in his custody to the respondent Police for the purpose of investigation. The respondent Police is directed to consider the claim of the petitioner and file appropriate final report at the earliest possible time, preferably within a period of three months from the date of receipt of a copy of this order.
