Mr.P.Siddarth, Government Advocate Order This Writ Petition is filed for a Mandamus directing the respondents 1 and 2 to consider and pass orders on the petitioner's representation dated 12.02.2026 seeking for the cancellation of temporary approval of Town Planning Pertaining to the residential plots in S.No.719/8 (Patta No.2408) now Patta No.3227 stands in the name of the respondents 3 to 5 herein in pursuance of the communication of the 2nd respondent dated 3.03.2026 in Na.Ka.53/2026 Thama within a stipulated time period.
2. The case of the petitioner is that the petitioner's ancestors are the owners of property admeasuring an extent of 96.33 cents of Parianahalli Village, Karimangalam Taluk, Dharmapuri Taluk and there are civil suits pending before various Court at Dharmapuri. Pending civil suits, the
respondents 3 to 5 purchased the property and obtained patta in their names under Patta Nos.2408 and 3227. Hence, the petitioner had submitted an objection on 12.02.2026 for the planning permission in respect of the above said land in favour of the respondents 3 to 5. Thereafter, vide proceedings dated 03.03.2026, the 2nd respondent forwarded the objection for appropriate action and the same is still pending without any action whatsoever. Hence, the present writ petition.
3. Heard the learned counsel for the parties and perused the materials.
4. Considering the limited scope of prayer, this Court, without expressing anything on merits, directs the 1st respondent to consider and dispose of the petitioner's representation dated 12.02.2026 and after affording opportunity of hearing to the petitioner and other interested parties, shall pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
