The above Civil Miscellaneous Petitions have been filed seeking a direction to to declare the respondents 3 to 5 in the above appeal as majors and to permit them to prosecute the above Second Appeal in their own name and discharge the 2nd respondent from the guardianship of minors respondents 3 to 5 in the above Second Appeal.
2. Today, when the matter was taken up for hearing, the learned counsel appearing for petitioners/respondents 3 to 5 submitted that, pending appeal, the 1st defendant died and his legal representatives were impleaded as respondents 2 to 5, at that time, respondents 3 to 5 were minors. Now, they have attained majority. Hence, the above petitions have been filed to declare them as majors and also to discharge 2nd respondent from the guardianship.
3. Mrs.R.Meenal, learned counsel takes notice on behalf of respondents 2 to 5 in the above appeal.
4. Considering the above facts and circumstances, these petitions are allowed.
5. Registry is directed to carry out necessary amendment in the cause title and post the matter on 07.08.2023.
