(Order of the Court was made by D.Bharatha Chakravarthy J.) Review Application has been filed to review the order dated 20.03.2024 passed in W.A.No.956 of 2024.

2. Learned counsel for the applicant would submit that the order suffers from an error on the face of record, since Section 4(3)(b) of the Tamil Nadu Acquisition of land for Harijan Welfare Schemes Act, 1978 has not been considered by the learned Single Judge, while passing the order, as no order was passed by the District Collector and the same was also overlooked by the Division Bench.

3. On perusal of the order that is sought to be reviewed, it can be seen that the appeal was rejected primarily on the ground that the Award proceedings were known to the appellant / review applicant herein and the review applicant chose not to appear and allowed the award to be passed on 23.03.2001. Belated challenge, after the acquisition proceedings is over and award was passed, cannot be

entertained and the writ appeal was decided. Therefore, the argument of the learned counsel for the Review Applicant in the present Review Application will not have any effect to dislodge the finding given in the Writ Appeal.

4. Accordingly, finding no merits in the Review Application, the same stands dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
