Respondent(s) PRAYER: This Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 to 4 herein to take appropriate action against the 5th respondent on complaint dated 07.12.2016 for not following the conditions imposed during the planning permission of construction of apartments and consequently direct the respondents 1 to 4 herein to impose compensation payable by the 5th respondents to the petitioner for causing health hazard, the mental agony by sleepless nights and compensation for entire compound wall on the eastern side of the petitioners house.

ORDER

On 19.02.2025, this Court has clearly stated that the petitioner shall pay Batta in respect of 5 th respondent within three working days, failing which, the aforesaid Writ Petition shall stands dismissed automatically without any further reference to this Court. It is stated that the Batta has not been paid by the petitioner.

2. In view of the peremptory nature of the order dated 19.02.2025, this Writ Petition is dismissed for default. No costs. Consequently, connected Miscellaneous Petition is closed.
