ORDER
This writ petition has been filed challenging the orders passed by the 1st respondent dated 20.08.2018 in Ref. 051/ 2015/ E2 reverting the petitioner from System Analyst post to the original post of Electrical Supervisor and consequently not to give effect of the relieving order dated 10.09.2018 passed by the 2nd respondent in proceedings No. 051/ 15/ E2 and not according to the Service Rule 12 of the respondent Sugar Corporation.

The petitioner originally joined as an Electrical Supervisor in Arignar Anna Sugar Mills, Thanjavur on 09.11.1992 and he was deputed to the Head Office of Tamil Nadu Sugar Corporation Ltd., (in short 'TASCO') on 01.04.2010. Subsequently, he was given with the additional charge as System Analyst in TASCO and later he was given with the responsibility of holding full additional charge for the said post from 16.04.2005.

The petitioner had joined the Head Office to look after the System Analyst / computer related work at TASCO on 09.08.2017 and he has joined as System Analyst only as per the letter of the Tamil Nadu Government Letter (2D) No.30 Industries (MIC-2) Dept. dated 09.08.2017 and the proceedings of the TASCO in No.051/2015/E2 dated 11.08.2017. Having assumed the said charge the petitioner now filed this writ petition stating that his reversion to the original post in the parental department is not proper.
4. From the records, it is learnt that the petitioner had been absorbed permanently in the post of System Analyst in TASCO. In fact the Government has also approved the said absorption and had sent a letter to the Managing Director of TASCO convening its approval. Under these circumstances, there is no question of reverting back the petitioner to his parent department.
5. In view of the above stated reasons, the impugned orders passed by the 1st respondent dated 20.08.2018 in Ref. 051/ 2015/ E2 and the relieving order passed by the second respondent dated 10.09.2018 in proceedings No. 051/ 15/ E2, are hereby quashed.
