ORDER

Seeking a direction to the respondent police to take the complaint dated 31.3.2015 on his file immediately and register the FIR, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3. It is represented by the learned Additional Public Prosecutor that the wife of the petitioner has lodged a complaint before the Kotturpuram Police Station, where the petition enquiry in CSR No.337/2015 is pending. This petitioner has lodged the present complaint before the respondent herein.

4. Under such circumstances, this Court directs the transfer of the present complaint of the petitioner dated 31.3.2015 from the file of R.9, Valasaravakkam Police Station, Chennai to the file of Kotturpuram Police Station, to be enquired along with CSR No.337/2015 and if the complaint discloses the commission of any cognizable offence, they are directed to register the complaint https://hcservices.ecourts.gov.in/hcservices/

and proceed further in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]..

5. This Criminal Original Petition is disposed of with the above direction.
