The petitioner, who was arrested and remanded to judicial custody on 27.04.2022 by the respondent police for the offences punishable under Sections Girl Missing @ 366 IPC, Section 9 of Prohibition of Child Marriage Act and Section 5(l) r/w 6 of POCSO Act 2012 in Crime No.79 of 2022, seeks bail.

2. The case of the prosecution is that, de-facto complainant's daughter aged about 16 years was found missing from 25.04.2022. Hence, the de-facto complainant lodged a complaint. Subsequently, the respondent police registered the above case and thereafter found that the petitioner herein had kidnapped the victim girl and married her. Hence, he was arrested and remanded to judicial custody on 27.04.2022.

3. On the pretext of love affair, the petitioner kidnapped the victim girl aged about 16 years and had physical penetrative sexual assault on her. Thereafter, the above complaint has been lodged by the father of the victim girl. 1/3

The victim girl was secured and the petitioner herein was remanded to judicial custody.

4. Therefore, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed. 15.07.2022 mpl 2/3
