Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the first respondent herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 07.02.2019, which has been forwarded to the first respondent by the second respondent in his proceedings dated 21/02/2019 with regard to appointment to the post of SubInspector of Police (Taluk) for the year 2015, on par with his batch mates with all consequential service benefits within a time frame.

With the consent of both the parties, the Writ Petition is taken up for final disposal at the state of admission itself.

The petitioner filed this Writ Petition seeking direction to the first respondent herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 07.02.2019, which has been forwarded to the first respondent by the second respondent in his proceedings dated 21/02/2019 with regard to appointment to the post of SubInspector of Police (Taluk) for the year 2015, on par with his batch mates with all consequential service benefits within a time frame.

The case of the petitioner is that the petitioner had participated and cleared the Written test, Interview, Medical test for appointment to the post of Sub-Inspector of Police, but the only reason for rejection of his claim was due to the reason that he was acquitted in C.C.No.256/2005 giving benefit of doubt. This Hon'ble Court has held that the acquittal of the petitioner in the above criminal case is an honourable acquittal. Thereafter the petitioner preferred a representation to the first respondent dated 07.02.2019 enclosing the orders of this Hon'ble Curt dated 21.12.2018 but till date no orders has been passed. Hence the present Writ Petition.
4. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the first respondent to consider the representation dated 07.02.2019 submitted by the petitioner and pass order on merits and in accordance with law.
5. Mr. A.N. Thambidurai, Special Government Pleader for the respondents agreed to dispose of the representation dated 07.02.2019 submitted by the petitioner within a reasonable time.
6. Considering the above facts and circumstances and the limited request made by the petitioner, I am inclined to issue direction to the first respondent to consider the representation dated 07.02.2019 and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
