The petitioner/Appellant has filed this petition to condone the delay of 40 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal, 2nd Additional District and Sessions Court, Chidambaram, Kanchipuram, in MCOP No.98 of 2016, dated 04.09.2019.

2. Heard the counsel for the appellant.

3. Eventhough notice served on the respondents and their names are also printed in the cause list, none appeared on behalf of the respondents.

3. Considering the submission made by the learned counsel and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and post the matter on 17.12.2020 for admission.
