Challenging the proceedings in C.C.No.110 of 2014 pending trial on the file of the Judicial MagistrateNo.1, Ulundurpet, Villupuram District, the petitioner has come up with this petition.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the petitioner submitted that in respect of the same cause of action, police investigation is pending in Crime No.117 of 2014. Hence, the petitioners have challenged the private complaint.

4. It is seen that the private complaint is also maintainable when police FIR is pending. But the learned Judicial Magistrate No.1, Ulundurpet, Villupuram District should act in accordance with Section 210 of Cr.P.C.
