Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the first respondent herein to dispose of the petition filed on 31.01.2013 within a reasonable time.

ORDER

Heard Mr.S.Jayasankar, learned counsel for the petitioner and Mr.M.L.Mahendran, learned Government Advocate appearing on behalf of the first respondent.

2. Since the writ petition is disposed of at the admission stage itself without notice to the second respondent, the merits of the allegations made by the petitioner as against the second respondent are not considered and it is left open to be decided by the authority concerned in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

3. According to the petitioner he has filed a petition dated 31.01.2013 before the first respondent against grant of patta in favour of the second respondent, which was acknowledged by the first respondent on the same day itself. However, till date no action has been taken up by the first respondent. It is stated that the second respondent is the Village Administrative Officer and he has obtained patta in his name under the Grama Natham scheme in respect of the petitioner's property also. Hence, the present writ petition.

4. In the light of the above, there will be a direction to the first respondent to consider the petition submitted by the petitioner dated 31.01.2013 after hearing both the petitioner as well as the second respondent and pass appropriate orders on the same within a period of three months from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
