This petition has been filed to direct the respondent police to register the Private Complaint dated 11.03.2015 filed by the petitioner before the Judicial Magistrate-II, Attur.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is the case of the petitioner that the counter petitioner had promised to get him a job of Supervisor in Singapore and had received Rs.3,50,000/-. Admittedly, this petitioner was sent to Singapore, but instead of Supervisor job he was given some other job, aggrieved by which the petitioner returned to Chennai and he is demanding return of money from the counter petitioner. The counter petitioner, it appears, has also repaid a sum of Rs.1,50,000/-. Beyond this, in the considered opinion of this Court, it cannot be stated that this is a case of cheating, inasmuch as when the petitioner is not satisfied with the job for which he was sent, that cannot be a grievance that the counter petitioner has cheated him. In any event, the petitioner has also lodged a complaint before the Magistrate.

Since this Court does not find commission of cognizable offence, it is not a fit case to issue directions as prayed for by the petitioner. Accordingly, this petition is closed with liberty to the petitioner to workout him remedy in the manner known to law. 01.06.2015 gms To 1.The Inspector of Police District Crime Branch Nethimedu, Salem.
