Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus to direct the 3rd respondent herein to consider and pass orders on the petitioner's representation dated 29.12.2017 for issue of patta to the petitioner in respect of lands to an extent of 50 cents in Survey No.35/1A6B and 4.50 acres in Survey No.223/2B1 of Kuruparapalli Village, krishnagiri Taluk, Krishnagiri District. Mr.S.Soundararajan, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a Mandamus directing the 2nd respondent to issue patta in respect of lands to an extent of 50 cents in Survey No.35/1A6B and 4.50 acres in Survey No.223/2B1 of Kuruparapalli Village, krishnagiri Taluk, Krishnagiri District, based on his representation dated 29.12.2017.

4. The grievance of the petitioner is that the said request has not been considered so far. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the 3rd respondent to consider and decide the same on merits and in accordance with law. Thus, this writ petition is disposed of by directing the 3rd respondent to consider the representation of the petitioner dated 27.12.2017 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the 3rd respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
