ORDER

This criminal original petition has been filed seeking a direction to the respondent to register a case based on the complaint dated 22.07.2016 given by the petitioner and investigate the matter in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor submits that the dispute is essentially between mother and son and there are three petitions enquiries are pending Viz., CSR Nos.269 of 2016, 312 of 2016 and 313 of 2016 and that the petitioner is not co-operating with the enquiries.

4. Under such circumstances, the petitioner is directed to co-operate with the enquiry and the respondent Police is directed to conduct enquiry and during the course of enquiry, if https://hcservices.ecourts.gov.in/hcservices/

any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner. With the above direction, this criminal original petition is closed.
