Civil Revision Petition filed under Article 227 of the Constitution of India to direct the learned II Additional District Judge, Puducherry to speedy dispose of the O.S.No.8 of 2018 by fixing the period to the Court to complete the trial which is pending on the file of the II Additional District Judge, Puducherry.

ORDER

This revision seeks for expeditious disposal of O.S.No.8 of 2018 pending on the file of the learned II Additional District Judge, Puducherry.

2. I called for a report from the learned II Additional District Judge, Puducherry on 12.11.2024.

3. The learned III Additional District Judge, II Additional District Judge (FAC), Puducherry has sent a report stating that issues were framed and this case is posted for trial on 28.11.2024 in special list. The report further reveals that the defendant raised the plea of non joinder of necessary parties, who are the sisters of the plaintiff and defendant.

4. Therefore, deciding the issues will take some time, subject to the cooperation of the plaintiff as well as defendant during the trial. Learned Judge has stated that he requires 6 months time to dispose this case.

5. Taking into consideration the report submitted by the learned III 2/4

Additional District Judge, II Additional District Judge (FAC), Puducherry, I am inclined to grant six months, from the date of receipt of a copy of this order, to dispose of O.S.No.8 of 2018.

6. With the above direction, this civil revision petition is disposed of. No costs.
