O R D E R
This Criminal Original Petition has been filed by the petitioner/accused to quash the FIR in Crime No.3 of 2021 registered for the offence under Sections 3(2)(a), 4(1), 5(1)(a) of Immoral Traffic (Prevention) Act, 1956, on the file of the respondent police on the ground of limitation.
2. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that out of three accused, one of the accused is absconding and therefore, the charge sheet filed by the respondent police was refused by the jurisdictional Magistrate.
3. Heard both sides and perused the materials available on record.
4. A perusal of the FIR shows that the cause of action arose on 13.09.2021 and the complaint has been lodged on the same day and therefore, there is no question of limitation.
5. Considering the facts and circumstances, the respondent police is directed to secure the absconding accused, complete the investigation and file the charge sheet within a period of one month from the date of receipt of a copy of this order.
6. With the above directions, this Criminal Original Petition is dismissed.
