WP No.21998 of 2013 The Hon`ble The CHIEF JUSTICE and The Hon`ble Mr Justice R. MAHADEVAN R.KANNAN GOVINDARAJULU NO.25, SAKTHI SREE NAGAR, KILMARUVATHUR VILLAGE, KANCHEEPURAM DISTRICT 603 319 Vs GOVERNMENT OF INDIA, REP. BY ITS CHIEF ELECTION COMMISSIONER, ELECTION COMMISSION OF INDIA, NIRVACHAN SADAN, NEW DLEHI-1 and 16 others.

The learned counsel for the Election Commission of India has produced before us a copy of the letter dated 15.09.2016 received by him from the Commission to the effect that the name of caste is not allowed to be made part of the name of a political party, but using the name of the race as part of the name of the political party would, in itself, may not amount to violation of any of the provisions of sub-section (5) of Section 29A of Representation of People Act, 1951 and thus would not be objectionable.

2. In so far as paragraph 5 of our order dated 04.07.2016 is concerned, the learned counsel for the Election Commission submits that the Election Commission had approached the Law Commission of India, which has already made a recommendation in these terms.

3. No further orders are required in this matter. [CJ] [R M D J] 16/09/2016
