Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to include the name of the petitioner in the panel for promotion to the post of Assistant Director of Town Panchayat for the year 2011-2012 in the appropriate place based on the seniority and consequently promote the petitioner to the post of Assistant Director of Town Panchayat on par with his Junior Thiru N.Rajendran and V.Mani retrospectively with all consequential and other attendant benefits including arrears of salary with interest, within a time frame.

The prayer sought for in the Writ Petition is to direct the respondents to include the name of the petitioner in the panel for promotion to the post of Assistant Director of Town Panchayat for the year 2011-2012 in the appropriate place based on the seniority and consequently promote the petitioner to the post of Assistant Director of Town Panchayat on par with his Junior Thiru N.Rajendran and V.Mani retrospectively with all consequential and other attendant benefits including arrears of salary with interest, within a time frame.

2. Today when the matter is taken up for hearing, the learned Counsel appearing for the petitioner submitted that the prayer sought for in the present writ petition has become infructuous and nothing survives for adjudication and he has also made an endorsement to that effect.

3. Recording the submissions made by the learned Counsel appearing for the petitioner, the writ petition stands dismissed as infructuous. Consequently, connected Miscellaneous Petition is closed. No costs.
