This petition has been filed to condone the delay of 62 days in filing the written statement.
2.In the affidavit filed in support of the Judges Summons, it had been contended that the applicants are Class-II legal heirs of deceased K.Soundarajan and were not arrayed as a party in the Original Petition. Thereafter, they had filed an application seeking to revoke the grant. The Original Petition was then converted as Testamentary Original Suit in T.O.S.No.86 of 2024. It had then been stated that summons was served on 14.02.2025 for filing of the written statement. The reason for the delay had been stated that the applicants could not personally come to give instructions for preparation of the written statement. 3.Heard the learned counsel for the respondents / plaintiff also. The learned counsel stated that questioning the order revoking the grant, O.S.A.No.198 of 2025 has been filed and is still pending. smv 4.Taking all the factors into consideration, the delay stands condoned. Accordingly, this petition stands allowed. The written statement of the 1st and 2nd defendants is taken for consideration.
