ORDER

(Order of the Court was made by M.S.RAMESH, J.) When the appellant herein had filed a Writ Petition in W.P.No.12617 of 2020, seeking for issuance of a Writ of Mandamus, for directing the respondents to promote him to the post of Superintendent, he was in service. Pending the Writ Petition, he has reached the age of superannuation on 30.11.2021. The learned Single Judge, through his final order dated 10.03.2022, had dismissed the Writ Petition by holding that the post of Assistant was not regularised and therefore, claim for promotion to the post of Superintendent is not permissible.

2. Before us, the grounds raised in the Writ Petition have been reiterated. However, the learned counsel appearing for the second respondent would submit that since the post of Assistant has not been notified, the appellant would not be eligible for promotion. On the other hand, he fairly submitted that the appellant would be eligible for MACP scale.

3. On our direction, the learned counsel appearing for the second respondent had also produced an order dated 17.11.2025 issued by the second respondent/Housing Board, extending the MACP benefits to the appellant. The learned counsel for the appellant also submits that the appellant's grievances have been redressed.

4. In the light of these developments, no further order is required in this Writ Appeal and accordingly, the Writ Appeal stands closed. No costs.
