Mrs.S.Pavithra, Standing Counsel for R1 COMMON ORDER The writ petitions are filed for the below relief: "directing the respondents to pay interest @ 10 percent for the belated payment of Gratuity, P.F., Leave Surrender Salary and Commutation of pension amount to the petitioners ".

2. The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners that they were retired employees of the respondent Corporation who worked as Tradesmen, Drivers and Conductors. The respondents settled the petitioners terminal benefits belatedly after 8-19 months. Therefore, the respondents are legally bound to pay interest to the

petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 10% p.a., for the belated payment of the petitioners terminal benefits such as Gratuity, P.F., Leave Surrender Salary and Commutation of pension amount. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Gratuity, P.F., Leave Surrender Salary and Commutation of pension amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Gratuity, P.F., Leave Surrender Salary and Commutation of pension amount within a period of one (1) month from the date of receipt of a copy of this order.
