This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to withdraw and transfer the case in C.A.No.143 of 2013 pending on the file of the IV Additional District Judge, Coimbatore, Coimbatore District to any other competent Court.

O R D E R

This petition has been filed seeking for transfer of the case in C.A.No.143 of 2013, pending on the file of the IV Additional District Court, Coimbatore.

The petitioner was convicted for an offence under Section 138 of Negotiable Instruments Act. Aggrieved by the same, the petitioner has filed an appeal before the Additional District Court, Coimbatore. This petition has been filed seeking for transfer only on the ground that the other connected appeals are pending before the III Additional District Judge, Coimbatore. Therefore, this appeal must also be transferred to the III Additional District Judge.

Admittedly both the appeals are independent cases and both will have to be decided on the facts of each case. It is not necessary that both should be heard by the same Judge. This Court does not find any ground to transfer the appeal. https://hcservices.ecourts.gov.in/hcservices/

In the result, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
