Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to mutate the patta in the name of the petitioner in S.F.No.403/9 situated at Mudalaipatti Village, Namakkal Taluk and District based on the representation of the petitioner dated 22.06.2023 within the stipulated period that may be fixed by this Court.

ORDER

Since no adverse Order has been passed against the second respondent, notice to her is dispensed with. With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the first respondent to mutate the patta in the name of the petitioner in S.F.No.403/9 situated at Mudalaipatti Village, Namakkal Taluk and District based on the representation of the petitioner dated 22.06.2023 within the stipulated period that may be fixed by this Court.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the first respondent and perused the materials available on record.

4. The case of the petitioner is that the petitioner and others filed a suit in O.S.No.162 of 2011 on the file of District Munsif Court, Namakkal seeking for declaration and other reliefs and the exparte decree passed in the 2/4

above suit has also been registered before the Sub Registrar Office on 03.01.2018. The grievance of the petitioner is that though the petitioner has given a representation to the first respondent seeking transfer of patta to their names, the same has not been considered by the first respondent. Hence, the present Writ Petition.

Considering the limited relief sought for by the petitioner, the first respondent is directed to consider the representation of the petitioner dated 22.06.2023 and pass Order on the same in accordance with law, after giving notice to the second respondent, within a period of two months from the date of receipt of a copy of this Order.

7. With the above direction, this Writ Petition is disposed of. No costs.
